These Terms and Conditions set out the basis on which Rubbish Collection Paddington provides waste removal, rubbish clearance and related services to domestic and commercial customers. By booking a collection, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the person, business or organisation requesting the rubbish collection or associated services.
We, us, our means Rubbish Collection Paddington, the service provider.
Services means rubbish collection, waste removal, clearance, loading, transportation and lawful disposal of permitted waste.
Waste means the materials, goods, items, rubbish or refuse that you ask us to collect and dispose of in accordance with applicable waste regulations.
2. Scope of Services
We provide a professional rubbish collection and waste removal service within Paddington and surrounding areas, subject to availability. The Services may include household waste clearance, commercial rubbish collection, garden waste removal, bulky item removal and other non-hazardous waste services, as agreed at the time of booking.
The exact scope of the Services, including the type and estimated volume of waste, access requirements and any additional tasks, will be confirmed during the booking process. We reserve the right to refuse any service request that falls outside our operational or legal capabilities, including but not limited to hazardous or prohibited waste.
3. Booking Process
3.1 Booking methods
You may request a booking by telephone or through our online enquiry or booking system, where available. A booking will only be considered confirmed when we have provided a clear confirmation of the collection date, time window and indicative price or pricing basis.
3.2 Information you must provide
You are responsible for providing accurate and complete information about the waste to be collected. This includes the approximate volume, type of items, location of the waste on the premises and any access restrictions such as stairs, limited parking, or narrow entryways.
3.3 Estimates and amendments
All times and arrival windows are estimates and may be subject to change due to traffic, access or operational issues. If you need to amend a booking, you must contact us as soon as possible prior to the scheduled collection time. Amendments are subject to availability and we do not guarantee that changes can be accommodated.
3.4 Access and attendance
You must ensure that either you or an authorised representative is present at the property during the agreed collection window to grant access and confirm the waste to be removed. If access is not available or the premises are unattended, we may treat the booking as a late cancellation, as described in the cancellations section.
4. Pricing and Payment
4.1 Pricing basis
Our pricing is typically based on the volume and type of waste, the labour required, and any additional charges such as parking, congestion or extra loading time. We will provide an estimate prior to or at the time of booking, based on the information you supply.
4.2 On-site assessment
Upon arrival, our team will assess the actual volume and nature of the waste. If this differs from the information provided at the time of booking, we may adjust the price accordingly. Where feasible, we will notify you of the revised cost before proceeding. If you do not agree to the revised price, you may cancel the service on site, but you may still be liable for a call-out or cancellation charge as detailed in the cancellations section.
4.3 Payment methods
Payment is due on or before completion of the Services, unless otherwise agreed in writing. We may accept payment by cash, debit card, credit card or other methods as communicated to you at the time of booking. For business customers, invoicing terms may be agreed separately, subject to credit approval.
4.4 Late payment
If any sum due to us is not paid on time, we reserve the right to charge interest and reasonable recovery costs in accordance with applicable UK law. We may also suspend or refuse further services until outstanding sums are paid in full.
5. Cancellations and Rescheduling
5.1 Customer cancellations
You may cancel or reschedule your booking by contacting us directly. Where possible, we ask for at least 24 hours notice prior to the scheduled collection time. If sufficient notice is provided, we will normally cancel or reschedule without charge.
5.2 Late cancellations and failed collections
If you cancel with less than 24 hours notice, or if our team attends the property and is unable to carry out the collection due to lack of access, absence of an authorised person, or the waste being significantly different from the description provided, we may charge a reasonable cancellation or call-out fee to cover our time, travel and administrative costs.
5.3 Cancellations by us
We may cancel or reschedule a booking due to circumstances beyond our control, including but not limited to severe weather, traffic disruption, vehicle breakdown, staff illness or safety concerns. In such cases, we will use reasonable endeavours to notify you as soon as possible and arrange a new collection time. We are not liable for any loss or inconvenience suffered as a result of such cancellations, provided we act reasonably in rescheduling the service.
6. Customer Responsibilities
6.1 Safe and lawful waste presentation
You must ensure that all waste intended for collection is safely presented and does not contain prohibited items or hazardous materials. Waste should be reasonably accessible and, where possible, segregated or identified as instructed by our team at the time of booking.
6.2 Access and parking
You are responsible for ensuring that our collection vehicle can park as close as reasonably possible to the property and that there are no legal or physical obstructions preventing access. Any parking fees, permits or fines incurred as a result of inaccurate information or failure to provide adequate access may be added to your final bill.
6.3 Ownership and authority
By presenting waste for collection, you confirm that you have the legal right to dispose of those items and that they do not belong to a third party without their consent. You agree to indemnify us against any claims or losses arising from the removal of items without proper authority.
7. Waste Types and Regulations
7.1 Compliance with UK waste law
We operate in accordance with applicable UK waste management and environmental regulations. All collected waste will be transported and disposed of through authorised facilities, with an emphasis on reuse and recycling where practicable.
7.2 Prohibited and hazardous waste
The Services do not cover certain types of hazardous or regulated waste, including but not limited to asbestos, clinical waste, biological materials, corrosive chemicals, pressurised gas cylinders, explosives, radioactive items and materials classified as hazardous under UK law. If you present such materials without prior agreement, we may refuse to collect them and, where appropriate, charge a call-out or partial service fee.
7.3 Electrical items and special handling
Some electrical and electronic equipment, batteries and other controlled items may be subject to specific disposal rules. Where we agree to collect such items, we will handle them in line with relevant regulations. You must advise us in advance if your waste contains electrical equipment or items that may need special handling.
8. Service Performance and Limitations
8.1 Reasonable care and skill
We will perform the Services with reasonable care and skill, consistent with a professional waste collection provider. Our team will take care when handling your property and premises; however, some minor scuffs or marks may be unavoidable where large or heavy items are removed from confined spaces.
8.2 Timeframes
We aim to complete collections within the agreed time window, but all times are estimates and not guarantees. Factors such as traffic, access difficulties or variations in the volume of waste can affect timing. We are not liable for delays outside our reasonable control.
8.3 Limits on dismantling and labour
Our service may involve some basic dismantling of items to facilitate removal, but does not include specialist trades work such as electrical disconnection, plumbing, or structural alterations. Where additional labour or time is required beyond that reasonably anticipated at booking, we may adjust the price to reflect the extra work, with your agreement.
9. Liability
9.1 Loss or damage
We are not liable for any loss or damage arising from inaccurate information provided by you, misuse of our Services, or failure to comply with these Terms and Conditions. We shall not be responsible for items that you intended to retain but which were not clearly separated or identified from the waste. You must ensure that no personal belongings, important documents or valuables are left among the items designated for removal.
9.2 Exclusions of liability
To the fullest extent permitted by law, we exclude all liability for indirect, consequential or economic loss, including loss of profit, loss of business, or loss of opportunity, arising out of or in connection with the provision of the Services.
9.3 Limits of liability
Our total liability to you in respect of any claim arising out of the Services shall not exceed the total price paid or payable for the specific service giving rise to the claim, except where such limitation is not permitted by law.
9.4 Non-excludable liability
Nothing in these Terms and Conditions shall exclude or limit our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other matter which cannot lawfully be excluded or limited under UK law.
10. Complaints and Disputes
10.1 Raising a concern
If you are dissatisfied with any aspect of our rubbish collection service, you should contact us as soon as possible, providing details of the issue and any supporting information. We take complaints seriously and will use reasonable efforts to investigate and respond within a reasonable time.
10.2 Resolution
Where appropriate, we may offer a remedy such as a partial refund, re-attendance or other practical solution. Any such remedy will be offered at our discretion, taking into account the circumstances, evidence provided and any applicable legal rights you may have as a consumer.
11. Data Protection and Privacy
In the course of providing our Services, we may collect and process personal information such as your name, contact details, service address and payment information. We will handle such data in accordance with applicable UK data protection law and use it only for the purposes of managing your bookings, delivering the Services, handling payments and fulfilling our legal obligations. We take reasonable steps to protect your information from unauthorised access or disclosure.
12. Variation of Terms
We may update or amend these Terms and Conditions from time to time to reflect changes in the law, operational needs or our service offering. Any revised terms will apply to new bookings from the date of publication. The terms in force at the time of your booking will apply to that particular service, unless changes are required by law or agreed with you.
13. Governing Law and Jurisdiction
These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales. You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim, except that if you are a consumer resident in another part of the United Kingdom you may also be able to bring proceedings in your local courts.
14. General Provisions
14.1 Entire agreement
These Terms and Conditions, together with any written confirmation of your booking and any agreed variations, constitute the entire agreement between you and us in relation to the Services, and supersede any previous discussions or representations.
14.2 Severability
If any part of these Terms and Conditions is found to be invalid or unenforceable by a court, the remaining provisions shall continue in full force and effect.
14.3 No waiver
Any failure or delay by us to enforce any right or provision of these Terms and Conditions shall not be deemed a waiver of such right or provision.
By making a booking with Rubbish Collection Paddington, you confirm that you have read, understood and agree to these Terms and Conditions and that you are authorised to enter into this agreement.
